Design Halo Terms and Conditions
Introduction
Thank you for choosing Design Halo. We are committed to providing you with outstanding design services, and our aim is to ensure that you are completely satisfied with the service we deliver. To ensure a smooth and professional relationship, please read through the following terms and conditions. By subscribing to our services, you agree to these terms.
1. Our Approach to Business
1.1 Client Satisfaction: Our primary goal is your satisfaction. We strive to deliver high-quality design services that meet your expectations.
1.2 Privacy and Security: We respect your privacy and any sensitive information you provide. We do not share, sell, or give away your information to third parties. We implement robust security measures to protect your data, including the use of strong passwords and secure communication channels.
1.3 Transparency and Communication: We believe in open and transparent communication. We will keep you updated on the progress of your projects and ensure that you are informed every step of the way.
2. Ownership and Intellectual Property
2.1 Ownership of Work: Ownership of any work produced by Design Halo remains with Design Halo until full payment is received. Access to design files and project deliverables will be restricted until all outstanding payments are settled.
2.2 Client Ownership: The client retains legal ownership of all design deliverables, including logos, branding materials, and other assets once the project is completed and all payments are made.
3. Project Terms
3.1 Design Process: Our design service operates on a subscription model where one design is worked on at a time. Designs are submitted and tracked through our in-house portal. Once a design is approved and signed off, any additional changes will be subject to additional charges.
3.2 Time Frames: While we strive to meet all agreed deadlines, we reserve the right to adjust timelines if unforeseen circumstances arise. We will communicate any changes as soon as possible.
3.3 Client Responsibilities: The client is responsible for providing accurate and complete information and for final proof-reading of all designs. Design Halo is not liable for any errors after final approval.
3.4 Third-Party Services: We reserve the right to engage third-party suppliers if we believe it is in the best interest of the client.
4. Payment Terms
4.1 Billing Schedule: Payment terms and billing schedules will be outlined in your subscription agreement. All invoices are non-refundable once paid.
4.2 Payment Methods: Initial payments must be made by electronic transfer (BACS). Ongoing monthly payments will be processed through Standing Order or Direct Debit using Stripe.
4.3 Late Payments: Payments are due within 14 days of the invoice date unless otherwise agreed in writing. Late payments will incur an interest charge of 6.1% per month on the outstanding balance. We reserve the right to suspend services if payment is not received within 14 days.
4.4 Service Cancellation: If you wish to cancel your subscription, a notice period of one calendar months is required. You will be invoiced for two additional months from the date of your cancellation request.
5. Confidentiality
5.1 Confidentiality Commitment: We guarantee confidentiality at all times. We will not disclose any client information to third parties unless required by law.
6. Complaints and Dispute Resolution
6.1 Complaints Procedure: If you have any complaints about our services, please first address them with your designated project manager. If the issue is not resolved, you may escalate the complaint in writing to our Managing Director. We aim to respond within 5 business days and are committed to resolving disputes promptly.
6.2 Abuse Reporting: Any issues related to abuse of services can be reported to hello@design-halo.com. We monitor this account regularly to address any concerns.
7. Changes to Terms and Conditions
7.1 Modifications: Design Halo reserves the right to modify these terms and conditions at any time. Clients will be notified of any changes in advance, and continued use of our services constitutes acceptance of the updated terms.
8. Governing Law
8.1 Jurisdiction: These terms and conditions are governed by US Laws for US and global clients, and laws of England and Wales for UK clients. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts.
